Father’s Day Matters

Father’s Day is a time to celebrate the fathers, grandfathers, stepfathers, and father figures who show up for the children who depend on them.

As a family law attorney, I often meet parents during some of the most difficult chapters of their lives. Some are navigating divorce. Some are working through parenting concerns. Even if the parents haven’t ever been married- court intervention is sometimes necessary. 

As a certified mediator and an attorney representing one party- I have worked with parents making these types of decisions. And helped advocate for them. While every family’s story is different, one thing remains true: children often benefit when they have safe, loving, and engaged parents who are committed to their well-being.

This Father’s Day, I want to take a moment to recognize the important role fathers can play in their children’s lives and discuss some of the rights available to fathers under Illinois family law.

Do Fathers Have Rights in Illinois?

Absolutely.

One of the most common misconceptions I hear is that courts automatically favor mothers over fathers. While that perception still exists, Illinois courts are not tasked with deciding which parent is more important. Instead, courts are charged with making decisions based upon the best interests of the child.

In many cases, that means encouraging both parents to remain actively involved in their child’s life whenever possible.

Depending on the circumstances, fathers may have the right to:

  • Establish parentage;
  • Seek parenting time with their children;
  • Participate in important decisions regarding education, healthcare, and extracurricular activities with the other parent 
  • Seek modification of child support 
  • Enforce existing parenting agreements and court orders; and
  • Maintain meaningful relationships with their children

Every case is unique, and the outcome will depend upon the specific facts involved. However, fathers should understand that Illinois law provides avenues for protecting and preserving the parent-child relationship.

Father’s Day Can Be Complicated 

Father’s Day can be a joyful occasion for many families. It can also be complicated for others.

Some fathers are celebrating a wonderful relationship with their children. Others may be working to rebuild a relationship, establish parenting time, or navigate the challenges that often accompany separation and divorce.

Regardless of where you are in your parenting journey, the opportunity to be a positive influence in a child’s life matters.
