What it is: an order issued to help protect people and/or children from harassment or violence. Orders of protection can be issued in a domestic relations (family) case. “Restraining order” is one (common) form of an order protection.
What this means for you: if you or your children are being harassed or fear violence, an order of protection is available — and the threat does not have to come from the spouse in the family case. These are civil remedies designed to keep you safe. Seek advice quickly: protection matters are time-sensitive.
Types: an emergency order can issue quickly (sometimes ex parte, without the other side present) and a plenary (full) order follows after a hearing. They can order no-contact, stay-away from home/work/school, and temporary parenting-time limits.
Watch out for: an order of protection is serious and can affect parenting, housing, and firearms. If one is filed against you, get a lawyer immediately — don’t ignore the hearing date.
